These Terms of Use ("Terms") govern your access to and use of the website at kakhaniandassociates.com ("the site") operated by Kakhani & Associates, Chartered Accountants, Bhilwara, Rajasthan, India ("we", "us", "the firm"). By accessing or using the site you agree to be bound by these Terms together with our Disclaimer and Privacy Policy. If you do not agree, you must not use the site.

1. Eligibility

You confirm that you are at least 18 years of age and competent to enter into a legally binding agreement under the Indian Contract Act, 1872. If you are accessing the site on behalf of an entity, you confirm that you have the authority to bind that entity to these Terms.

You may view and, where reasonable, print copies of pages for your personal informational use, but you may not otherwise copy, reproduce, republish, upload, post, transmit, distribute, or modify any content without our prior written consent.

The use of the prefix "CA" before the name of a member of the firm reflects that member's status as a Chartered Accountant in accordance with ICAI rules. The official mark of the Institute of Chartered Accountants of India ("ICAI") is the property of ICAI and is used, if at all, only in accordance with the Institute's brand guidelines.

5. Download Returns and authenticated areas

Where the site provides a facility for a client to download deliverables relating to that client's own professional engagement (for example, downloading an income-tax return prepared by the firm), access is restricted by authentication. You agree not to attempt to access deliverables that do not belong to you. Access to the firm's internal practice management module (located at /desk/) is restricted to authorised personnel of the firm; any attempted access by an unauthorised person may be reported to the appropriate authorities.

6. No professional engagement created by use of the site

Use of the site, including submission of an enquiry, does not by itself create a Chartered Accountant–client relationship between you and the firm. Such a relationship arises only after a formal engagement letter or terms of service has been executed between you and the firm.

The site is provided "as is" and "as available". To the maximum extent permitted by law, the firm disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. The firm does not warrant that the site will be uninterrupted, secure, free of errors, or free of viruses or other harmful components.

To the maximum extent permitted by law, in no event shall Kakhani & Associates, its partners, employees, or representatives be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of, or inability to use, the site, even if we have been advised of the possibility of such damages. Nothing in these Terms limits liability that cannot lawfully be limited under Indian law.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid or unenforceable provision shall be replaced by a valid and enforceable provision that most closely reflects the intent of the original.
